TERMS & CONDITIONSBy commissioning me, you agree to the following Terms of Service.These terms apply to commissions placed through VGen as well as private commissions, although some procedures may vary depending on the platform.

✦ PAYMENT & COMMISSION METHODS
• Commissions placed through VGen must be paid via the platform’s payment system.• Private commissions (outside of VGen) can be discussed and arranged via:- Email. 💌: [email protected]
- Discord. 🔮: ohvenny_• All private commission payments must be made via PayPal invoice.
Work will not begin until payment is received.• Payment must be made upfront.• For commissions over $100 USD, a payment plan may be discussed:- 50% upfront (sketch phase)
- 50% after sketch approval (before final rendering)• If the commission is intended for merchandise, branding, book covers, or any profit-generating use, it will be considered commercial use and may require an additional 100–200% fee, depending on the project.• Privacy fee: +100% of the total price if the artwork should not be posted publicly (not applicable for temporary privacy).✦ COPYRIGHT & LICENSE
The artist retains full copyright of the commissioned artwork.Purchasing a commission does not transfer intellectual property rights to the client.The client receives a limited license to use the artwork according to the agreed usage type (personal or commercial).The client may not:- Claim the artwork as their own.
- Resell, redistribute, or modify it for commercial purposes without permission.
- Remove, crop, or alter the artist’s signature or watermark.✦ COMMERCIAL USE
Displayed prices are for personal use only, including:- streaming
- thumbnails
- videos
- social media posts
- content creationThe use of the artwork for merchandise, branding, logos, or any profit-generating activity is considered commercial use and requires a commercial license.Important: I do not accept fanart commissions of canon characters for merchandise purposes.✦ SIGNATURE / WATERMARK
The artist reserves the right to include their signature or watermark on the final artwork.This signature may not be removed, cropped, or modified without the artist’s permission.Clients may share the artwork as long as proper credit is given.✦ PROHIBITED USE
My artwork may not be used for:- AI training
- AI datasets
- AI art platforms
- NFTs✦ REVISIONS
• Clients may request up to 3 major revisions during the sketch phase, including changes to:- pose.
- anatomy.
- facial expression.
- clothing.• Additional revisions may require an extra fee depending on complexity.• After sketch approval, only minor adjustments may be requested (color tones, line colors, etc.).• Changes that require redoing large portions of the artwork after sketch approval may incur additional fees.✦ ESTIMATED DELIVERY TIME
Completion time may vary depending on:- artwork complexity
- commission queue
- personal circumstancesAn estimated delivery time will be provided, but it may change if unforeseen circumstances occur.Clients will be informed in case of significant delays.If a client needs the artwork by a specific date, they must inform me in advance.Rush orders or priority placement may require an additional fee.✦ COMMISSION PROCESS
Once payment is received:- I will send an initial sketch for approval.
- After sketch approval, I will proceed to coloring and rendering.
- Minor color adjustments may be requested even after the final version is delivered.✦ CANCELLATIONS & REFUNDS• Cancellations are allowed before payment is sent.• Once work has begun and the first sketch is started, no refunds will be issued.• If the artist cannot complete the commission due to unforeseen circumstances, a partial or full refund may be issued depending on the progress made.Commissions through VGen may also follow platform policies.✦ COMMISSION ABANDONMENT
If the client stops responding for 30 days or more after feedback, approval, or required information is requested, the commission will be considered abandoned.The artist may cancel the commission without obligation to continue work or issue a refund.✦ DISPUTES & CHARGEBACKS
By sending payment for a commission, the client confirms that they have read and agreed to these terms.Initiating a chargeback or payment dispute after receiving progress or final artwork will be considered a violation of these terms.If a chargeback is initiated without attempting to resolve the issue first, the client will automatically lose all rights to use the commissioned artwork and may be blacklisted from future commissions.✦ CLIENT RESPONSIBILITY / CONTENT
The artist reserves the right to decline commissions that are illegal, inappropriate, offensive, or violate third-party rights.Clients are responsible for providing accurate references and clear instructions.The artist is not responsible for misinterpretation or dissatisfaction if instructions are unclear.✦ FILE DELIVERY
The delivery includes only the agreed file types: JPG or PNG.Editable files (PSD, layers, source files, etc.) will never be provided, under any circumstances.✦ COMMUNICATION
Communication must be in English or Spanish.Rude, inappropriate, or disrespectful messages may result in commission cancellation or blacklisting.✦ HOW TO COMMISSION
